End User License Agreement (EULA)

Effective

Upon consent to the EULA at the time of purchasing your Brightly resource(s) or membership, you enter into this End User License Agreement.

Company

You are entering an agreement with Brightly, a preaching resource company registered in the United States as a D/B/A associated with John C. Emmert and located at www.planbrightly.com.

At the time of purchase, you are given the option to agree or not agree to the terms of this EULA. After your consent and purchase, you are bound to this agreement between you and Brightly. 

Permitted Use

1. You may download your Brightly resource(s) to a local storage device.
2. You may edit the contents of the outlines and discussion questions.
3. You may use up to 200 words of the outlines verbatim.
4. You may display the sermon image graphics as is. Sermon notes may be displayed on top of Sermon background images.
5. You may use your Brightly resources for presentation in a church service.
6. You may stream and/or upload services that use Brightly material to online platforms.
7. You may share your purchased Brightly resource with up to two other ministers employed by the same church that you are. 

Restricted Use

1. You may not resale any document or image downloaded from Brightly.
2. You may not use Brightly Titles, Main Points, Challenges, Images or quotes in a for-profit venture or event without prior consent from Brightly.
3. You may not share your purchased Brightly resource with people not currently employed by the same church where you are employed. 

Limitations

1. If more than three ministers belonging to the same church would like to use a Brightly resource, additional copies or memberships must be purchased at www.planbrightly.com.
2. If you choose to post on social media, print or publish verbatim material from your Brightly resource, you must acknowledge Brightly as the author.
3. Your use of a Brightly resource purchased without membership may continue unless you request a refund for that resource. Upon request of resource refund, this EULA is terminated and your use of that Brightly resource is prohibited.
4. Your use of Brightly resources downloaded with a membership may continue unless you request a refund within one year of purchasing that membership. Upon request of membership refund, this EULA is terminated and your use of Brightly resources downloaded during the annual cycle of the refunded membership is prohibited. 

Terminations

1. Brightly may terminate this agreement and all rights of your purchase and/or membership if you are deemed to have breeched this EULA.
2. You may terminate this agreement within 30 days of your consent and purchase if you deem that the material is unusable for your setting. You may do so by beginning the refund process. 

Refunds

1. The refund process may be initiated by contacting brooke@planbrightly.com.
2. If you request a refund of any Brightly resource or membership, you must cease to use refunded Brightly resources or resourced downloaded during the annual cycle of the refunded membership. You may re-purchase Brightly resources and/or re-establish a Brightly membership to continue use of Brightly resources.
3. If you continue to use refunded Brightly resources or materials downloaded during the annual cycle of a refunded membership after requesting refund, you will be subject to penalties under EULA and Copyright laws in the state of Tennessee. 

Liability

Brightly is not responsible for how you choose to present material or the responses of your audience. 

Jurisdiction

This EULA is entered into in the state of Tennessee and is subject to pertinent laws regarding copyright, intellectual property and EULA.
